DMCA Policy
Coconut Desserts is committed to respecting the intellectual property rights of others. We take copyright infringement very seriously and will respond to notices of alleged copyright infringement that comply with the Digital Millennium Copyright Act (DMCA) and other applicable intellectual property laws. This policy outlines the information required to submit a proper notification to Coconut Desserts and how we will address such claims.
If you believe that your copyrighted work has been copied in a way that constitutes copyright infringement and is accessible via the Coconut Desserts website or services, please notify our Copyright Agent as set forth in the DMCA. For your complaint to be valid under the DMCA, you must provide the following information when providing notice of the claimed copyright infringement:
Filing a DMCA Notice of Infringement
To file a DMCA notice, you must provide a written communication that includes substantially the following:
- An electronic or physical signature of the person authorized to act on behalf of the owner of the copyright's interest.
- A description of the copyrighted work that you claim has been infringed, including the URL (i.e., web page address) of the location where the copyrighted work exists or a copy of the copyrighted work.
- Identification of the material that is claimed to be infringing and where it is located on the Coconut Desserts site, including a specific URL.
- Information reasonably sufficient to permit Coconut Desserts to contact you, such as your address, telephone number, and e-mail address.
- A statement that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.
- A statement by you, made under penalty of perjury, that the above information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner's behalf.
DMCA Counter-Notification Procedure
If you believe that your content was removed or disabled by mistake or misidentification, you may send a counter-notification. The DMCA allows you to send a counter-notification to us for content that was removed or disabled. Your counter-notification must contain the following:
- Your physical or electronic signature.
- Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access to it was disabled.
- A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
- Your name, address, and telephone number.
- A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or if your address is outside of the United States, for any judicial district in which Coconut Desserts may be found, and that you will accept service of process from the person who provided the original DMCA notification or an agent of such person.
